British Columbia is Strengthening Water Sustainability Regulations

In an effort to better protect water used by people, wildlife and communities in British Columbia, the government of British Columbia has strengthened regulations under the Water Sustainability Act. The update will promote compliance with water management best practices by increasing the fines for violations under the Act. The regulations will allow for penalties of as much as $100,000 for a general contravention and as much as $500,000 for high-penalty offences defined under the Act. The exact amount of a fine will be determined by the comptroller of water rights following an investigation by compliance and enforcement staff.

There is never a bad time to improve water management on an industrial site, but it’s always a good reminder to assess management practices when the government increases fines.  Potential areas to consider include:

Permit Obligations.  A permit is required to use water or discharge water from an industrial site.  Are you meeting all of the requirements of your permit?  Have there been any changes to discharge regulations?  Have there been changes in operation that are not captured by the permit?

Water Treatment Plant Compliance.  Is the WTP achieving discharge requirements?  Has there been a historical change in operation that suggests a potential failure?  Is there any equipment nearing its lifespan?  Do you have replacement parts on-site in case of emergencies? How do you ensure inlet water quality meets guidelines?

Water Management.  Is there a formal plan to prevent contaminated water from escaping the site when the plant is out of compliance?  Is there a spill control plan?
